1. Introduction
These Terms and Conditions ("Terms") govern the use of the emergency contact calling platform and services ("Service") provided by Pointible Technologies Private Limited ("Pointible", "we", "us", or "our"). By registering or using the Service via any identifier (QR code, printed ID, Bag tags Digital token, etc.), you ("User") agree to be bound by these Terms.
2. Description of Service
Pointible provides a backend emergency contact calling platform that enables Users to pre-register their emergency contacts. When activated, the system initiates an automated call to the registered emergency contact(s) within a short time frame (typically under 60 seconds) without disclosing the personal contact details of the caller.
Pointible does not manufacture or distribute physical tags, cards, or other hardware, but provides a digital infrastructure that can be integrated by third-party partners into physical or digital products.
3. User Responsibilities
- Users must accurately input and update their emergency contact information via the activation process provided.
- Users are solely responsible for informing their emergency contacts of their role and obtaining their consent.
- Users must not use the service for prank, malicious, or non-emergency purposes.
- If a physical medium (ID card, tag, sticker) is lost or damaged, the user must request reactivation or replacement through the relevant issuing partner.
- The platform must not be used in violation of any local laws or to impersonate others.
4. Refund Policy
We offer a 14-day money-back guarantee for all subscription plans. If you are not satisfied with our service, you may request a refund within 14 days of your initial purchase. For annual subscriptions canceled after 30 days, we may provide a prorated refund at our discretion.
4. Data Privacy
- Pointible does not publicly display or share any user or contact phone numbers during the service interaction.
- All data is processed in accordance with applicable Indian data protection regulations.
- Emergency contact information is stored securely and used only for the purpose of enabling this service
- Users retain the right to access, modify, or delete their registered emergency contact information at any time by logging into their account.
5. Service Limitations
- The Service is intended as a supportive emergency contact mechanism and should not replace formal emergency services (ambulance, police, fire, etc.).
- Service availability may be affected by mobile network issues, hardware limitations, or third-party integration failures.
- Pointible is not responsible for call failures resulting from telecom outages, incorrect numbers, or unresponsive emergency contacts
6. Intellectual Property
- The platform and all related technologies are protected under Indian patent law. Unauthorized use, copying, or replication is strictly prohibited.
- All software, trademarks, designs, and processes associated with the service remain the sole intellectual property of Pointible Technologies Private Limited
7. Modifications to Service
- Pointible reserves the right to enhance, modify, or discontinue parts of the service without prior notice. Updated terms will be made available via our official communication channels.
8. Liability and indemnity
- Pointible shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the service.
- Users agree to indemnify and hold Pointible harmless against any misuse or unauthorized access caused by the User’s negligence or breach of these Terms
9. Governing Laws and Jurisdiction
- These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Mumbai, Maharashtra..
